Marikina legalizes mobile vending

To enable marginalized residents with mobile vending operations as means of livelihood, the city government of Marikina recently legalized the operation of mobile vendors in the city. The move is supported by Ordinance 04, Series of 2011 which is authored by Councilor Susana Magtubo. The ordinance stipulates that mobile vendors legalize their operation by registering with the city government through the Market Office. Registration fee is PhP500 for Marikina residents, and PhP2,000 for non-Marikina residents. Upon registration, they must submit the following requirements: community tax certificate or cedula; barangay business permit; voter’s identification card or voter’s registration certificate; and identification of two kinds of primary items or wares to be sold. For proper identification, registered mobile vendors must also wear proper uniform during operation. Each uniform is worth PhP125. After registration and payment, the Market Office shall issue to the mobile vendor the following: a health certificate (for mobile food handlers), an identification card, a business vending certificate, and a vest (uniform). According to Mayor Del De Guzman, such a move is seen as a solution to help lower income residents spur livelihood and productivity. “We simply could not deny the fact that some residents rely on peddling to be able to earn a living. Legalizing and regulating their operation is a way of helping them earn decently and more substantially,” said De Guzman. To ensure that the operation of mobile vendors is regulated, the ordinance mandates certain restrictions such as prohibition of the following: staying over a long period of time and permanently occupying any space on any sidewalk or street or public or private places where vending or peddling is prohibited; peddling or vending within a fifty (50) meter-radius of any school or educational institution, churches or religious establishment, and public or private markets; storing or leaving his or her wares, goods or merchandise on any sidewalk, street or area where it is a public obstruction; strewing and/or throwing litter, garbage and leftovers of his wares, goods, merchandise on any public place or do such other acts to create rubbish or unsanitary conditions in any place; selling or vending of stale, rotten or contaminated food stuff; selling or vending illegal wares, goods or merchandise; carrying or transporting wares, goods, merchandise that can create harm or injury to pedestrians; and selling at the city’s major thoroughfares, overpasses and footbridges. “In as much as we would like to allow our peddlers to earn, we also would like to protect the welfare and promote the safety of the consuming public. Every individual that operates business in our city must be responsible for their operation. We believe that the creation of this ordinance gives our authorities and all concerned individuals the proper guidelines on mobile vending,” De Guzman added. Mobile vendors violating the ordinance shall be faced with a fine of PhP300 (first offense), PhP600 (2nd offense), and PhP2,000 (3rd offense). In lieu of the imposed fine, community service shall be rendered by the violator. Confiscated goods can be claimed within four hours for perishable goods and 72 hours for non-perishable items.
